Sảy thai được hưởng những chế độ gì ?

Tôi làm việc cho 1 công tý tư nhân. Hiện đã đóng bảo hiểm xã hội được gần 2 năm. Mới đây vì sự cố nên tôi bị sảy thai.Vậy tôi có được bảo hiểm thanh toán không?

 

Theo Điều 30 Luật bảo hiểm xã hội năm 2006 quy định về thời gian hưởng chế độ khi sẩy thai, nạo, hút thai hoặc thai chết lưu như sau: “Khi sẩy thai, nạo, hút thai hoặc thai chết lưu thì lao động nữ được nghỉ việc hưởng chế độ thai sản mười ngày nếu thai dưới một tháng;hai mươi ngày nếu thai từ một tháng đến dưới ba tháng; bốn mươi ngày nếu thai từ ba tháng đến dưới sáu tháng; năm mươi ngày nếu thai từ sáu tháng trở lên”.

Thời gian nghỉ việc hưởng chế độ thai sản quy định tại Điều này tính cả ngày nghỉ lễ, nghỉ Tết, ngày nghỉ hằng tuần.

Đồng thời Điều 35 Luật bảo hiểm xã hội cũng quy định về mức hưởng chế độ thai sản như sau:

“1. Người lao động hưởng chế độ thai sản theo quy định tại các điều 29, 30, 31, 32 và 33 của Luật này thì mức hưởng bằng 100% mức bình quân tiền lương, tiền công tháng đóng bảo hiểm xã hội của sáu tháng liền kề trước khi nghỉ việc.

2. Thời gian nghỉ việc hưởng chế độ thai sản được tính là thời gian đóng bảo hiểm xã hội. Thời gian này người lao động và người sử dụng lao động không phải đóng bảo hiểm xã hội”.

Theo các quy định nêu trên bạn sẽ được nghỉ 20 ngày, trong đó bao gồm cả ngày nghỉ lễ, nghỉ tết và ngày nghỉ hàng tuần. Bạn sẽ được trả tiền lương cho 20 ngày này với mức bằng 100% mức bình quân tiền lương, tiền công tháng đóng bảo hiểm xã hội của sáu tháng liền kề trước khi nghỉ việc.
