Hợp đồng trong hoạt động xây dựng được quy định như thế nào?

 

Điều 107 Luật Xây dựng số 16/2003/QH11 của Quốc hội quy định:

1. Hợp đồng trong hoạt động xây dựng được xác lập cho các công việc lập quy hoạch xây dựng, lập dự án đầu tư xây dựng công trình, khảo sát xây dựng, thiết kế công trình, giám sát, thi công xây dựng công trình, quản lý dự án xây dựng công trình và các công việc khác trong hoạt động xây dựng.

2. Hợp đồng trong hoạt động xây dựng được xác lập bằng văn bản phù hợp với quy định của Luật này và các quy định khác của pháp luật có liên quan.

3. Tuỳ theo quy mô, tính chất của công trình, loại công việc, các mối quan hệ của các bên, hợp đồng trong hoạt động xây dựng có thể có nhiều loại với nội dung khác nhau.
