Thế nào là bí mật kinh doanh?

 

Trả lời: Bí mật kinh doanh là thành quả đầu tư dưới dạng thông tin đáp ứng đủ các điều kiện sau:

Không phải là hiểu biết thông thường.

Khi sử dụng trong kinh doanh tạo cho người nắm giữ thông tin có lợi thế so với người không nắm giữ hoặc không sử dụng bí mật kinh doanh đó.

Được chủ thông tin bảo mật bằng các biện pháp cần thiết để thông tin đó không bị tiết lộ và không dễ dàng tiếp cận được (Điều 84 Luật SHTT).

Sở hữu bí mật kinh doanh tự động xác lập khi có đủ các điều kiện trên.
