Tôi làm ở công ty cũ gần 2 năm vì công việc quá áp lực nên tôi xin nghĩ. Khi tôi nghĩ việc thì có mâu thuẫn với sếp.Nên khi tôi nghĩ việc, cty cũ không chịu trả lại sổ Bảo hiểm cho tôi.Giờ đây tôi xin vô làm ở công ty mới, họ yêu cầu tôi nộp sổ để gộp tiếp quá trình, nhưng tôi không có sổ nộp vào, chỉ đọc số sổ cho cơ quan bhxh thôi. Hỏi vậy làm sao tôi lấy được sổ bảo hiểm nếu cty cũ vẫn không chịu trả sổ bảo hiểm . Và nếu tôi không có sổ nộp vào cơ quan BHXH ,chỉ cung cấp số sổ thÔI ,THÌ khi tôi nghĩ chế độ thai sản có được hưởng chế độ thai sản không?

1. Khi quan hệ lao động chấm dứt, công ty buộc phải chốt và trả sổ BHXH cho bạn, việc công ty không trả sổ bảo hiểm là không thực hiện đúng quy định pháp luật. Bạn có thể làm đơn yêu cầu tổ chức hòa giải tranh chấp đòi sổ BHXH ra Phòng LĐTBXH nơi công ty cũ có trụ sở để hòa giải giải quyết tranh chấp, nếu hòa giải không thành thì bạn khởi kiện ra Tòa án để tòa án giải quyết vấn đề của bạn.
2. Về việc chế độ thai sản, bạn đang đóng bảo hiểm ở công ty mới và đủ điều kiện hưởng chế độ thai sản thì công ty mới làm thủ tục cho bạn hưởng chế độ thai sản mà không cần sổ bảo hiểm cũ được trả hay chưa, khi bạn khai số sổ cũ và đóng theo sổ cũ là quá trình đóng bảo hiểm xã hội của bạn đã được tiếp tục cập nhật, quá trình đó được xem xét cho điều kiện hưởng chế độ thai sản.
Về mặt lâu dài, không thể không lấy lại sổ bảo hiểm xã hội ở công ty cũ. Do đó bạn cần hành động như mục 1 để bảo vệ quyền lợi của mình.
Nếu bạn không có thời gian hoặc điều kiện khác, chúng tôi có thể cung cấp dịch vụ pháp lý để yêu cầu công ty cũ trả sổ cho bạn khi bạn yêu cầu chúng tôi.
