Xin chào Quý Luật sư!
Tôi có vấn đề này nhờ quý luật sư vấn ạ.
Tôi là công chức tháng 10/2013 tôi bị kỷ luật hình thức là khiển trách.
Đến tháng 12/2015 cơ quan tôi chuẩn bị nâng lương trước hạn cho cán bộ công chức đủ điều kiện. Tôi muốn hỏi trường hợp của tôi vậy có được nâng lương trước hạn không ạ, theo Thông từ 08/2013/TT-BNV ngày 31/7/2013. Năm 2014, 2015 tôi đều hoàn thành xuất sắc nhiệm vụ.
Trong cùng một ngạch, ví dụ đang giữ ngạch chuyên viên mà bị kỷ luật thì có được nâng lương trước hạn không?
Trong thông tư 08/2013/TT-BNV về việc nâng lương trước hạn có nêu "Thành tích để xét nâng bậc lương trước thời hạn được xác định theo thời điểm ban hành quyết định công nhận thành tích đạt được trong khoảng thời gian 6 năm gần nhất đối với các ngạch và các chức danh có yêu cầu trình độ đào tạo từ cao đẳng trở lên" theo tôi hiểu là thích đạt được cao nhất cho khoảng thời gian 6 năm hay là thích tích cao nhất đạt được trong thời gian 6 năm liên tục ạ. Và có bắt buộc phải có bằng khen của UBND tỉnh mới được nâng lương trước hạn ạ.
Rất mong nhận được câu trả lời sớm của Quý luật sư vì cơ quan tôi sắp họp để xét nâng lương trước hạn ạ.

 

Chào bạn, trường hợp của bạn chúng tôi xin tư vấn như sau:
Căn cứ theo quy định tại Điểm a Khoản 1 Điều 3 và Điểm a Khoản 1 Điều 2 thông tư 08/2013/TT-BNV quy định thì trường hợp của bạn không đủ điều kiện nâng lương trước hạn.
Theo quy định tại Ä‘iểm Ä‘ Khoản 1 Điều 3 thông tÆ° 08/2013/TT-BNV nhÆ° bạn đề cập thì việc xét thành tích để nâng lÆ°Æ¡ng  khoảng thời gian 6 năm gần nhất được hiểu là 5 năm liên tiếp gần nhất đối vá»›i các ngạch và các chức danh có yêu cầu trình Ä‘á»™ đào tạo từ cao đẳng trở lên...
