Tôi vào công ty từ 28/8/2013 thử việc, được 1 tháng là ngày 28/9/2013 tôi được ký HĐLĐ. Được 1 năm là 28/9/2014 công ty chấm dứt HĐLĐ với tôi, trong thới gian 1 năm đó thì tôi mang thai, dự kiến sinh ngày 2/12/2014. Vậy cho tôi hỏi tôi chấm dứt HĐLĐ trước 2 tháng khi sinh con thì có được hưởng chế độ thai sản không?

 Căn cứ theo quy định luật Bảo hiểm xã hôi quy định:

1. Người lao động được hưởng chế độ thai sản khi thuộc một trong các trường hợp sau đây:

a) Lao động nữ mang thai;

b) Lao động nữ sinh con;

c) Người lao động nhận nuôi con nuôi dưới bốn tháng tuổi;

d) Người lao động đặt vòng tránh thai, thực hiện các biện pháp triệt sản.

2. Người lao động quy định phải đóng bảo hiểm xã hội từ đủ sáu tháng trở lên trong thời gian mười hai tháng trước khi sinh con hoặc nhận nuôi con nuôi.

Như vậy, theo quy định trên thì trong khoảng thời gian 12 tháng trước khi sinh, nếu bạn đã đóng bảo hiểm xã hội đủ 6 tháng trở lên thì tuy bạn nghỉ việc nhưng vẫn sẽ được hưởng chế độ thai sản theo quy định của pháp luật.
