Cách tính tiền bảo hiểm thai sản

em sinh con vào tháng 11/2012, làm chế độ bảo hiểm thai sản tháng 12/2012. Em làm ở công ty TNHH Chất mỹ, mức đóng bảo hiểm của em (trước khi sinh 6 tháng)là 1,4 triệu. Đến thời điểm này em đã có tiền bảo hiểm thai sản là 5.3 triệu.Em đang thắc mắc cách tính bảo hiểm như thế nào. Vậy em không được hưởng 2 tháng trợ cấp tã lót lương cơ bản sao?

 

Điều kiện hưởng chế độ thai sản :
- Tại Điều 28, Luật BHXH số 71/QH11 quy định : đối với người lao động lao động nữ sinh con và người lao động nhận nuôi con nuôi dưới bốn tháng tuổi là phải đóng BHXH từ đủ sáu tháng trở lên trong thời gian mười hai tháng trước khi sinh con hoặc nhận nuôi con nuôi.
- Tại tiết b, khoản , mục II, phần B Thông tư số 03/2007/TT-BLĐTBXH ngày 30/01/2007 của Bộ Lao động Thương binh và Xã hội quy định :

Mức hưởng khi nghỉ việc sinh con hoặc nuôi con nuôi = Mức bình quân tiền lương, tiền công tháng đóng bảo hiểm xã hội của 6 tháng liền kề trước khi nghỉ việc X Số tháng nghỉ sinh con hoặc nghỉ nuôi con nuôi theo chế độ

- Tại Điều 34, Luật BHXHsố 71/QH11 quy định :
Lao động nữ sinh con hoặc người lao động nhận nuôi con nuôi dưới bốn tháng tuổi thì được trợ cấp một lần bằng hai tháng lương tối thiểu chung cho mỗi con.
Nếu bạn đủ điều kiện hưởng thai sản theo quy định nêu trên và trong 6 th¸ng liÒn kÒ tr­íc khi nghØ viÖc bạn tham gia đóng BHXH với mức là 1 400 000 đồng, bạn làm việc trong điều kiện bình thường thì chế độ trợ cấp thai sản của bạn được tính như sau :
1 400 000 đồng x 04 tháng = 5 600 000 đồng
         1 050 000 đồng x 02 tháng =  2 100 000 đồng
                                   Tổng cá»™ng = 7 700 000 đồng
