Toi lv o cty Duoc pham duoc duoc 2,5nam bat dau tu 11/2008. Nhung toi bat dau dong BHTN tu 6/2010- nhung den thang 11/2010 la toi nghi hau san 5 thang (den dau thang 4/2011 bat dau vao lam lai cong ty). Den thang 7/2011 thi toi xin nghi viec o nha nuoi con va xin huong BHTN. Neu noi rang Thoi gian nghi hau san Cty va toi ko dong BHXH ma van duoc huong nguyen quyen loi, Thi tai sao khi hoi ra de xin bao hien that nghiep thi no toi dong BHTN chua du thoi gian 1 nam( chi moi dong 7 thang)vi nghi 5 thang hau san.Su viec da qua. Nhung toi van muon biet su viec nhu vay la co dung khong? Va quyen loi :Theo Điều 35 Luật bảo hiểm xã hội thì thời gian bạn nghỉ chế độ thai sản thì công ty và bạn không phải đóng BHXH mà vẫn được tính vào thời gian đóng BHXH.trong truong hop nay nen duoc hieu nhu the nao?

Theo Khoản 2 Điều 35 Luật bảo hiểm xã hội năm 2006 thì: “Thời gian nghỉ việc hưởng chế độ thai sản được tính là thời gian đóng bảo hiểm xã hội. Thời gian này người lao động và người sử dụng lao động không phải đóng bảo hiểm xã hội.”
Tuy nhiên, theo quy định tại Khoản 2 Điều 8 TT 32/2010/TT-BLĐTBXH ngày 25/10/2010 của Bộ Lao động Thương binh và xã hội: “Trường hợp người lao động nghỉ việc hưởng chế độ thai sản hoặc ốm đau từ mười bốn ngày làm việc trở lên trong tháng, không hưởng tiền lương, tiền công tháng tại đơn vị mà hưởng trợ cấp bảo hiểm xã hội thì cả người lao động và người sử dụng lao động không phải đóng bảo hiểm thất nghiệp trong tháng đó. Thời gian này không được tính để hưởng bảo hiểm thất nghiệp khi bị mất việc làm hoặc chấm dứt hợp đồng lao động, hợp đồng làm việc”.
NhÆ° vậy thời gian bạn nghỉ sinh bạn không phải đóng bảo hiểm xã há»™i, bảo hiểm y tế và bảo hiểm thất nghiệp, và thời gian đó không được tính để hưởng bảo hiểm thất nghiệp. 
Vì vậy, bạn vẫn chưa đủ điều kiện để được hưởng bảo hiểm thất nghiệp (đã đóng bảo hiểm thất nghiệp đủ mười hai tháng trở lên trong thời gian hai mươi bốn tháng trước khi thất nghiệp).
