Sinh con khi hết hạn hợp đồng được hưởng BHXH không ?

Em làm ở một công ty Nhật được hơn 2 năm, đến tháng 7-2014 hết hạn hợp đồng lao động (HĐLĐ). Hiện em đang mang thai, nếu đến tháng 7-2014 công ty không ký tiếp hợp đồng thì khi sinh con, em có được hưởng chế độ thai sản không? (Hương Quỳnh)

 Theo Điều 14 Nghị định 152/2006/NĐ-CP ngày 22-12-2006 của Chính phủ hÆ°á»›ng dẫn má»™t số Ä‘iều của Luật bảo hiểm xã há»™i (BHXH) về BHXH bắt buá»™c, thì Ä‘iều kiện hưởng chế Ä‘á»™ thai sản theo khoản 2 Điều 28 Luật BHXH gồm:

1. Lao động nữ sinh con phải đóng BHXH từ đủ 6 tháng trở lên trong thời gian 12 tháng trước khi sinh con.

2. Trường hợp người lao động đủ điều kiện quy định tại khoản 1 Điều 14 Nghị định 152/2006/NĐ-CP, nghỉ việc trước thời điểm sinh con thì vẫn được hưởng chế độ thai sản theo quy định tại các Điều 31 (thời gian hưởng chế độ khi sinh con), Điều 34 (trợ cấp một lần khi sinh con) và khoản 1 Điều 35 (mức hưởng chế độ thai sản) Luật BHXH.

Căn cứ theo quy định nêu trên, nếu đến tháng 7-2014 HĐLĐ của bạn hết hạn mà công ty không ký tiếp hợp đồng với bạn, nhưng bạn đang mang thai và nếu bạn đã đóng BHXH từ đủ 6 tháng trở lên trong thời gian 12 tháng trước khi sinh con thì bạn vẫn được hưởng chế độ thai sản khi sinh con.

Trường hợp sinh con trước ngày 15 của tháng, thì tháng sinh con không tính vào thời gian 12 tháng trước khi sinh con. Trường hợp sinh con từ ngày 15 trở đi của tháng, thì tháng sinh con được tính vào thời gian 12 tháng trước khi sinh con (theo mục 1 khoản II phần B Thông tư số 03/2007/TT-BLĐTBXH, ngày 30-1-2007 của Bộ LĐ-TB&XH hướng dẫn thực hiện một số điều của Nghị định số 152/2006/NĐ-CP).
