Tôi làm việc hơn 7 tháng, vì có việc riêng nên xin nghỉ phép. Cơ quan cho rằng tôi làm việc chưa đủ 12 tháng nên không được nghỉ phép”. Một số lao động (quận Tân Phú - TPHCM)

 Đối với những trường hợp làm việc chưa đủ 12 tháng thì số ngày nghỉ sẽ được tính tương ứng với thời gian làm việc. Điều 11, Nghị định 195/CP ngày 31-12-1994 hướng dẫn cách tính số ngày phép này như sau: Lấy số ngày nghỉ hằng năm, chia cho 12 tháng (không lấy số thập phân) nhân với số tháng làm việc thực tế trong năm để tính thành số ngày được nghỉ hằng năm có lương. Trường hợp của bà làm đủ 7 tháng được nghỉ 7 ngày phép.
