Trợ cấp BHXH theo chế độ thai sản

Tôi tham gia BHXH bắt buộc từ tháng 2/2006 đến tháng 1/2008, hiện đang mang thai được 5 tháng.
Từ tháng 2/2008 tôi nghỉ việc ở công ty n ên không tiếp tục tham gia BHXH bắt buộc nữa. Như vậy khi sinh con (khoảng tháng 8/2008) th ì tôi có được hưởng trợ cấp BHXH theo chế độ thai sản không? Nếu có thủ tục nhận trợ cấp như thế nào?

 Theo khoản 2 điều 28 Luật Bảo hiểm xã hội thì lao động nữ sinh con muốn được hưởng chế độ thai sản phải đảm bảo điều kiện: đóng BHXH đủ 6 tháng trở l ên trong vòng 12 tháng trước khi sinh con.
 
Bạn sinh con vào tháng 8/2008 thì khoảng thời gian 12 tháng trước khi sinh con được tính từ tháng 8/2007. Bạn đống bảo hiểm xã hội đến tháng 1/2008 thời ngừng đóng. Trong khoảng 12 tháng trướ khi sinh con bạn mới đóng BHXH được đủ 6 tháng do vậy bạn được hưởng chế độ thai sản theo quy định..
 
Bạn cần cung cấp cho cơ quan BHXH các giấy tờ sau:
 
- Sổ BHXH, Bản sao giấy chứng sinh hoặc giấy khai sinh của con.
