Doanh nghiệp gặp rất nhiều khó khăn trong việc đăng ký lại theo qui định vì việc đăng ký lại kéo theo sự thay đổi toàn bộ kết cấu nội bộ doanh nghiệp như việc điều hành, quản trị...., việc điều chuyẻn vốn, tài sản .... Nay doanh nghiệp muốn xin gia hạn thêm thời gian đăng ký lại thì thủ tục như thế nào? Cám ơn sự hỗ trợ của quý cơ quan. 

 

Thời gian thực hiện việc đăng ký lại được quy định tại Điều 170 của Luật Doanh nghiệp (Luật do Quốc Hội ban hành). Do đó, việc gia hạn thời gian đăng ký lại không thuộc thẩm quyền của Sở Kế hoạch và Đầu tư. Ngoài ra, Sở cũng chưa nhận đươc văn bản hưởng dẫn của cấp có thẩm quyền việc việc gia hạn thời gian đăng ký lại.
