Hiện nay căn cứ theo các quy định hiện hành thì chÆ°a có bất cứ văn bản nào của cÆ¡ quan nhà nÆ°á»›c quy định cụ thể về hình thức xá»­ lý giáo viên vi phạm chính sách kế hoạch hóa gia đình. Do đó, hình thức xá»­ lý sẽ được thá»±c hiện theo ná»™i quy, quy định của Ä‘Æ¡n vị trường nÆ¡i bạn công tác đề ra. Ngoài ra, nếu người  vi phạm là Đảng viên thì sẽ bị xá»­ lý ká»· luật Đảng, 
 
Quyết định 94 của Bộ Chính trị và hướng dẫn số 11 của Đảng nêu rõ: Đảng viên sinh con thứ 3 sẽ bị cảnh cáo, đối với cán bộ giữ chức vụ lãnh đạo sẽ bị cách chức; sinh con thứ 4 sẽ bị khai trừ. Với cán bộ công chức, viên chức không phải Đảng viên, Tổng cục Dân số cũng kiến nghị, nếu sinh con thứ 3 sẽ bị cách chức nếu như đang giữ chức vụ lãnh đạo và sẽ bị cảnh cáo nếu không giữ cương vị lãnh đạo; sẽ không đề bạt bổ nhiệm vào những vị trí lãnh đạo, không được chuyển ngạch công chức, kéo dài thời gian nâng lương...
căn cứ theo "Mục 1 Điều 7 HÆ°á»›ng dẫn số 01-HD/UBKTTW, ngày 26/4/2011 của Ủy ban Kiểm tra Trung Æ°Æ¡ng, hÆ°á»›ng dẫn thá»±c hiện Quyết định số 09 - QĐ/TW, ngày 24-3-2011 của Bá»™ Chính trị về việc bổ sung, sá»­a đổi Điều 7, Quy định số 94-QĐ/TW, ngày 15-10-2007 của Bá»™ Chính trị (khóa X) về xá»­ lý ká»· luật Đảng viên vi phạm chính sách dân số, kế hoạch hóa gia đình"
