Cho cháu hỏi: Công ty cháu thành lập tháng 3 năm 2008. Đã làm hợp đồng và bảng lương cho nhân viên nhưng không biết để gửi danh sách cho cơ quan BHXH. Bây giờ muốn đóng BHXH cho nhân viên có được không. Có bị phạt vì không nộp danh sách không.

 Theo quy định thì công ty bạn buộc phải truy đóng BHXH cho người lao động kể từ tháng 3/2008.
 
Thủ tục như sau:
 
Người sử dụng lao động: Lập "Danh sách truy đóng BHXH, BHYT bắt buộc" (Mẫu số 04 -
TBH) và công văn kèm theo các hồ sơ liên quan của người lao động gửi cơ quan BHXH.
 
Cơ quan BHXH: Tiếp nhận hồ sơ, tiến hành kiểm tra, xác định số tiền phải truy đóng; mức truy đóng là 20% BHXH và 3% BHYT (nếu có) tính theo tiền lương, tiền công và mức lương tối thiểu tại thời điểm đóng.
 
Trong thời gian phải truy đóng nếu người lao động bị ốm đau, thai sản, tai nạn lao
động và có khám chữa bệnh thì người sử dụng lao động phải chịu trách nhiệm bồi ho àn chi phí cho người lao động.
