Phương thức giải quyết tranh chấp sau khi hòa giải không thành

Hai doanh nghiệp đã xảy ra tranh chấp liên quan đến hợp đồng mua bán hàng hóa. Hai bên đã thỏa thuận giải quyết tranh chấp bằng hòa giải thương mại nhưng hòa giải không thành. Xin hỏi, trong trường hợp này các bên có thể lựa chọn phương thức nào để giải quyết tranh chấp?

Văn phòng Luật sư Tô Đình Huy trả lời: Theo quy định tại khoản 4 Điều 15 của Nghị định số 22/2017/NĐ-CP thì trường hợp không đạt được kết quả hòa giải thành, các bên có quyền tiếp tục hòa giải hoặc yêu cầu Trọng tài hoặc Tòa án giải quyết tranh chấp theo quy định của pháp luật.

Do đó, nếu không hòa giải thành thì hai doanh nghiệp trên có quyền yêu cầu Trọng tài hoặc Tòa án giải quyết tranh chấp theo quy định.
