Đề nghị cho biết đối với đơn tố cáo vi phạm pháp luật, sách nhiễu, tiêu cực trong quá trình tiến hành các thủ tục xác lập văn bằng bảo hộ sở hữu công nghịêp, thanh tra, xử phạt vi phạm hành chính về sở hữu công nghiệp thì gửi cho cơ quan nào?

 

Văn phòng Luật sư Tô Đình Huy trả lời: Trong trường hợp phát hiện các hành vi vi phạm pháp luật, sách nhiễu, tiêu cực trong quá trình tiến hành các thủ tục xác lập văn bằng bảo hộ sở hữu công nghịêp, thanh tra, xử phạt vi phạm hành chính về sở hữu công nghiệp của công chức nhà nước ở các ơ quan có thẩm quyền liên quan, thì tổ chức, cá nhân phát hiện gửi đơn đến cho thủ trưởng của công chức đó. Trường hợp công chức đó là Thủ trưởng đơn vị thì gửi đơn cho Thủ trưởng cấp trên của người đó (Luật Khiếu nại, tố cáo, Luật Phòng, chống tham nhũng).
