Tổ chức, cá nhân bị thanh tra, kiểm tra, kiểm soát về sở hữu công nghiệp có quyền khiếu nại quyết định, kết luận và quyết định xử phạt vi phạm hành chính không?

 

Văn phòng Luật sÆ° Tô Đình Huy trả lời: Tổ chức, cá nhân là đối tượng của hoạt Ä‘á»™ng thanh  tra, kiểm tra về sở hữu công nghiệp có quyền khiếu nại quyết định thanh  tra, kiểm tra  kết luận  của Đoàn thanh tra, kiểm tra, thanh tra viên, kiểm soát viên, cảnh sát khi tiến hành thanh  tra, kiểm tra tại cÆ¡ sở mình nếu có căn cứ cho rằng các quyết định, kết luận thanh tra, kiểm tra không đúng quy định.

Tổ chức, cá nhân bị xá»­ phạt vi phạm hành chính về sở hữu công nghiệp có quyền khiếu nại vá»›i người ra quyết định xá»­ phạt  về căn cứ  xá»­ phạt, áp dụng hành vi, mức phạt và các biện pháp khác đã áp dụng đối vá»›i mình (Điều 53 Luật Thanh tra).
