Không tham gia bảo hiểm thất nghiệp

Người sử dụng lao động không tham gia bảo hiểm thất nghiệp cho người lao động trong thời gian đang thực hiện hợp đồng lao động (ví dụ: nợ BHXH…) thì thời gian đó có được tính là thời gian trợ cấp thôi việc ?

 Theo quy định về các đối tượng bắt buá»™c tham gia bảo hiểm thất nghiệp tại Điều 43 Luật Việc làm số 38/2013/QH13 ngày 16/11/2013 thì Doanh nghiệp nếu thuá»™c đối tượng theo quy định nêu trên nếu không tham gia BHTN cho người lao Ä‘á»™ng là trái vá»›i quy định. Nếu doanh nghiệp nợ BHXH thì thời gian đó không được tính là thời gian hưởng trợ cấp thôi việc.
