Thời hạn cho thuê lại lao động

Công ty H có nhu cầu thuê lại 20 lao động của công ty K với thời hạn 24 tháng. Hỏi thời hạn cho thuê lại lao động được quy định như thế nào ? Việc ký hợp đồng cho thuê lại lao động của công ty K có đúng quy định của pháp luật không?

Trả lời:

Điều 26 Nghị định số 55/2013/NĐ-CP quy định về thời hạn cho thuê lại lao động như sau:

1. Thời hạn cho thuê lại lao động tối đa không quá 12 tháng.

2. Khi hết thời hạn quy định tại Khoản 1 Điều này, doanh nghiệp cho thuê lại lao động không được tiếp tục cho thuê lại người lao động với bên thuê lại mà người lao động thuê lại vừa hết thời hạn cho thuê lại.

          Đối chiếu vá»›i quy định trên việc cho thuê lại lao Ä‘á»™ng của công ty K là không đúng vá»›i quy định của pháp luật, hai bên phải hủy bỏ hợp đồng đã ký và tiến hành ký má»›i má»™t hợp đồng khác thay thế vá»›i thời hạn cho thuê lại lao Ä‘á»™ng không quá 12 tháng vá»›i bên thuê lại. Sau khi hết thời hạn cho thuê lại lao Ä‘á»™ng, nếu công ty K có nhu cầu thì thuê lại lao Ä‘á»™ng khác của bên cho thuê lại lao Ä‘á»™ng.
