Thời gian vừa qua, do công ty làm ăn thua lá»— và phải trả lãi ngân hàng hàng tháng nên trong 03 tháng nay Công ty cổ phần cung ứng dịch vụ lao Ä‘á»™ng chÆ°a trả lÆ°Æ¡ng cho người lao Ä‘á»™ng thuê lại. Xin hỏi để đảm bảo việc thá»±c hiện nghÄ©a vụ của doanh nghiệp cho thuê lại lao Ä‘á»™ng đối vá»›i người lao Ä‘á»™ng thuê lại,  pháp luật có quy định gì để bảo đảm cho người lao Ä‘á»™ng ?

Trả lời:

Để bảo đảm quyền lợi cho người lao Ä‘á»™ng,  tại Điều 15 Nghị định số 55/2013/NĐ-CP quy định rõ về sá»­ dụng tiền ký quỹ nhÆ° sau:

Tiền ký quỹ được sử dụng để thanh toán tiền lương hoặc bồi thường cho người lao động thuê lại trong trường hợp doanh nghiệp cho thuê lại lao động vi phạm hợp đồng lao động với người lao động thuê lại hoặc gây thiệt hại do không bảo đảm về quyền và lợi ích hợp pháp của người lao động thuê lại.
