Từ ngày ông J (người nÆ°á»›c ngoài) được Ban Giám đốc công ty Ä‘Æ°a  sang Ä‘iều hành chi nhánh công ty đặt tại Việt Nam, ông J đã yêu cầu công Ä‘oàn công ty không được phép can thiệp vào phÆ°Æ¡ng thức quản lý người lao Ä‘á»™ng do ông ta đặt ra, kể cả khi sa thải người lao Ä‘á»™ng trái pháp luật, ai có ý kiến sẽ bị ká»· luật cách chức, hạ bậc lÆ°Æ¡ng.

Xin hỏi, pháp luật quy định như thế nào về trách nhiệm của đơn vị sử dụng lao động để bảo đảm hoạt động của công đoàn cơ sở?

Trả lời:

          Theo quy định tại Khoản 1 Điều 24 Luật công Ä‘oàn năm 2012, cÆ¡ quan, tổ chức, doanh nghiệp có trách nhiệm bố trí nÆ¡i làm việc và tạo Ä‘iều kiện về phÆ°Æ¡ng tiện làm việc cần thiết cho công Ä‘oàn cùng cấp hoạt Ä‘á»™ng.

          Điều 15 Nghị định số 43/2013/NĐ-CP cÅ©ng quy định trách nhiệm của Ä‘Æ¡n vị sá»­ dụng lao Ä‘á»™ng, cÆ¡ quan, tổ chức, cá nhân có liên quan bảo đảm các Ä‘iều kiện hoạt Ä‘á»™ng công Ä‘oàn: “đơn vị sá»­ dụng lao Ä‘á»™ng, tổ chức đại diện người sá»­ dụng lao Ä‘á»™ng, cÆ¡ quan, tổ chức cá nhân có liên quan có trách nhiệm cung cấp thông tin, phối hợp, tạo Ä‘iều kiện thuận lợi để công Ä‘oàn các cấp thá»±c hiện quyền, trách nhiệm trong việc đại diện, bảo vệ quyền, lợi ích hợp pháp, chính đáng của người lao Ä‘á»™ng”.

          Hành vi của ông J được coi là hành vi cản trở hoạt Ä‘á»™ng của tổ chức công Ä‘oàn, hành vi này sẽ bị xá»­ phạt vi phạm hành chính theo quy định pháp luật.
