Vì không đồng ý với chế độ lương và thời giờ làm việc của công ty, sau nhiều lần đề nghị tăng lương, giảm giờ làm mà không được chấp thuận, một số công nhân đã đề nghị công đoàn đứng ra tổ chức đình công. Xin hỏi, khi tổ chức và lãnh đạo cuộc đình công thì công đoàn có quyền và trách nhiệm như thế nào?

Trả lời:

Theo quy định tại Điều 210, Bộ luật lao động, việc đình công phải do Ban chấp hành công đoàn cơ sở tổ chức và lãnh đạo, ở nơi chưa có tổ chức công đoàn cơ sở thì đình công do tổ chức công đoàn cấp trên tổ chức và lãnh đạo theo đề nghị của người lao động.

Khi tổ chức và lãnh đạo cuộc đình công, công đoàn có quyền và trách nhiệm theo quy định tại Điều 12 Nghị định số 43/2013/NĐ-CP như sau:

- Lấy ý kiến của tập thể lao Ä‘á»™ng để đình công theo quy định của pháp luật về lao Ä‘á»™ng;

- Ra quyết định đình công và thông báo thời Ä‘iểm bắt đầu đình công;

- Rút quyết định đình công nếu chÆ°a đình công;

- Tiến hành đình công theo quy định của pháp luật về lao Ä‘á»™ng;

- Thá»±c hiện quy định về không được đình công, hoãn, ngừng đình công theo quy định của pháp luật về lao Ä‘á»™ng;

- Yêu cầu Tòa án tuyên bố cuộc đình công là hợp pháp theo quy định của pháp luật.
