Quyền, trách nhiệm của Công đoàn trong tranh chấp lao động

Theo quy định pháp luật, khi có tranh chấp lao động xảy ra, công đoàn có quyền, trách nhiệm gì trong việc tham gia với cơ quan, tổ chức, cá nhân có thẩm quyền giải quyết tranh chấp lao động?

Trả lời:

Việc giải quyết tranh chấp lao động nhằm hài hòa lợi ích của hai bên tranh chấp, ổn định sản xuất, kinh doanh, bảo đảm trật tự an toàn xã hôi. Do vậy, trong quá trình giải quyết tranh chấp lao động công đoàn cơ sở đóng vai trò rất quan trọng. Theo đó, Điều 8 Nghị định số 43/2013/NĐ-CP quy định công đoàn cơ sở có quyền yêu cầu bằng văn bản đối với cơ quan, tổ chức, cá nhân có thẩm quyền giải quyết tranh chấp lao động bảo đảm đúng trình tự, thủ tục theo quy định pháp luật.

Ngoài ra, công đoàn cơ sở có trách nhiệm:

- Hướng dẫn, hỗ trợ người lao động giải quyết tranh chấp lao động cá nhân khi người lao động yêu cầu; đại diện cho người lao động tham gia quá trình giải quyết tranh chấp lao động cá nhân khi được người lao động ủy quyền;

- Tham gia phiên họp giải quyết tranh chấp lao động cá nhân của hòa giải viên lao động theo yêu cầu.

Công Ä‘oàn cấp trên có trách nhiệm tham gia vá»›i cÆ¡ quan, tổ chức, cá nhân có thẩm quyền trong việc giải quyết tranh chấp lao Ä‘á»™ng tập thể  và há»— trợ công Ä‘oàn cÆ¡ sở thá»±c hiện quyền, trách nhiệm của mình.
