Cách tính thời gian nghỉ thai sản

Tôi đã có 8 năm công tác giảng dạy tại trường thcs. hiện nay tôi đang có thai, và dự kiến tôi sẽ sinh vào tháng 4/ 2014 này. theo qui định mới tôi sẽ được nghĩ sản trong 6 tháng. như vậy, thời gian nghỉ sản của tôi sẽ trùng vào 2tháng hè. Xin quí luật sư cho tôi hỏi liệu tôi có được nghỉ trừ bù thêm 2 tháng hè đó không? Tôi xin chân thành cam ơn.

Tại Ä‘iều 14 Nghị định số 152/2006/NĐ-CP ngày 22.12.2006 hÆ°á»›ng dẫn má»™t số Ä‘iều của Luật BHXH về BHXH bắt buá»™c (Nghị định số 152/2006/NĐ-CP) thì Ä‘iều kiện hưởng chế Ä‘á»™ thai sản theo khoản 2, Ä‘iều 28 Luật BHXH được quy định nhÆ° sau: “1. Lao Ä‘á»™ng nữ sinh con và người lao Ä‘á»™ng nhận nuôi con nuôi dÆ°á»›i 4 tháng tuổi phải đóng BHXH từ đủ 6 tháng trở lên trong thời gian 12 tháng trÆ°á»›c khi sinh con hoặc nhận nuôi con nuôi.”

Theo quy định tại Điều 157 Bá»™ Luật Lao Ä‘á»™ng năm 2012, có hiệu lá»±c thi hành từ ngày 1/5/2013, nếu lao Ä‘á»™ng nữ đáp ứng đủ Ä‘iều kiện về thời gian đóng BHXH theo quy định của Luật BHXH thì được nghỉ hưởng chế Ä‘á»™ thai sản trÆ°á»›c và sau khi sinh con là 6 tháng. 

Thời gian nghỉ việc hưởng chế độ thai sản tính cả ngày nghỉ lễ, nghỉ Tết, ngày nghỉ hàng tuần.

Do đó, bạn không được nghỉ trừ bù thêm 02 tháng hè đó.
