Điều kiện để được hưởng chế độ tai nạn lao động

Anh K bị tai nạn lao động với tỉ lệ thương tật là 40%. Gia đình anh K đề nghị công ty C nơi anh K làm việc thực hiện các thủ tục để anh K được hưởng chế độ tai nạn lao động. Sau khi nộp hồ sơ đề nghị hưởng chế độ, hồ sơ đã bị gửi trả lại với lý do chưa đủ các giấy tờ cần thiết. Gia đình anh K băn khoăn không biết phải bổ sung những loại giấy tờ nào?

Theo Điều 104, Luật bảo hiểm xã hội 2014, hồ sơ hưởng chế độ tai nạn lao động phải gồm có những văn bản sau đây:

- Sổ bảo hiểm xã hội.

- Biên bản điều tra tai nạn lao động, trường hợp bị tai nạn giao thông được xác định là tai nạn lao động thì phải có thêm biên bản tai nạn giao thông hoặc biên bản khám nghiệm

hiện trường và sơ đồ hiện trường vụ tai nạn giao thông.

- Giấy ra viện sau khi đã điều trị tai nạn lao động.

          - Biên bản giám định mức suy giảm khả năng lao Ä‘á»™ng của Há»™i đồng giám định y khoa.

          - Văn bản đề nghị giải quyết chế Ä‘á»™ tai nạn lao Ä‘á»™ng.

Như vậy, để hoàn thiện hồ sơ hưởng chế độ tai nạn lao động, gia đình anh K phải phối hợp với công ty nơi anh K làm việc đáp ứng đầy đủ 5 loại văn bản trên.
