Quy định về việc gặp, gửi thư, tiền, quà cho học sinh trường giáo dưỡng

H là học sinh của trường giáo dưỡng X. Vậy theo quy định của pháp luật, người thân của H muốn gặp, gửi thư, tiền, quà cho H phải tuân thủ theo những quy định nào?

 

Văn phòng Luật sư Tô Đình Huy trả lời:Việc gặp người thân, nhận, gửi thư, nhận tiền quà của H (học sinh trường giáo dưỡng) được quy định tại Điều 24 Nghị định số 02/2014/NĐ-CP, cụ thể như sau:

Học sinh được gặp người thân tại nhà thăm gặp của trường giáo dưỡng, được liên lạc với thân nhân bằng điện thoại và phải chấp hành đúng những quy định tại Nghị định này và hướng dẫn của Bộ Công an về thăm gặp và liên lạc bằng điện thoại.

Người đến thăm học sinh phải xuất trình Chứng minh nhân dân. Trường hợp ngủ lại qua đêm tại trường giáo dưỡng phải được sự đồng ý của Hiệu trưởng trường giáo dưỡng.

 Học sinh được nhận và gá»­i thÆ°, nhận tiền, quà (trừ rượu, bia, thuốc lá, các chất kích thích, đồ vật và các loại văn hóa phẩm bị cấm). Trường giáo dưỡng có trách nhiệm kiểm tra thÆ°, giám sát ná»™i dung các cuá»™c nói chuyện Ä‘iện thoại và các loại quà trÆ°á»›c khi trao cho học sinh. Riêng tiền hoặc giấy tờ có giá, học sinh phải gá»­i vào bá»™ phận lÆ°u ký của trường giáo dưỡng và được sá»­ dụng theo quy định của Bá»™ Công an.
