Xin Chào Luật Sư,
Cho tôi hỏi hiện nay trên thị trường Việt Nam có nhãn hiệu bưởi hồ lô Thành Huy nhưng tôi được biết Nội dung bảo hộ ghi trong các văn bằng chỉ có giá trị độc quyền về nhãn hiệu bưởi và kiểu dáng cái khuôn chứ chưa thể độc quyền việc sản xuất, kinh doanh trái bưởi hồ lô.
Như vậy việc tôi có sản xuất và kinh doanh bưởi hồ lô nhưng kiểu dáng khuôn mẫu ( Chữ in trên khuôn hoặc không có chữ) khác như nhãn hiệu trên thì có được pháp luật công nhận không?

Đến thời điểm hiện tại, bưởi hồ lô Thành Huy được đăng ký bảo hộ độc quyền về nhãn hiệu bưởi và kiểu dáng cái khuôn. Do đó, bạn không có quyền sản xuất, kinh doanh bưởi hồ lô với nhãn hiệu "bưởi hồ lô Thành Huy" hoặc sản xuất bưởi hồ lô bằng khuôn giống khuôn đã được bảo hộ. Điều này đồng nghĩa với việc bạn được sản xuất bưởi hồ lô không nhãn hiệu hoặc nhãn hiệu khác và sử dụng khuôn mẫu khác với khuôn mẫu được bảo hộ.
