Tôi là giáo viên công tác lâu năm trong ngành giáo dục. Vợ không có nghề nghiệp, con còn nhỏ (Cháu đầu 14 tuổi, cháu thứ 2 mới 2 tuổi). Vợ và con tôi thường xuyên đau ốm phải đi các cơ sở y tế để khám và điều trị bệnh. Xin hỏi với hoàn cảnh trên thì tôi có phải đi biệt phái hay không? (Điều kiện của tôi là khó khăn nhất trong cơ quan.)

Theo quy định tại Điều 36 Luật viên chức năm 2010 và Điều 26 Nghị định 29/2012/NĐ-CP về tuyển dụng và quản lý viên chức liên quan đến việc biệt phái viên chức thì đối tượng không phải thực hiện biệt phái viên chức chỉ có viên chức nữ đang mang thai hoặc nuôi con dưới 36 tháng tuổi. Theo đó, trường hợp hoàn cảnh gia đình bạn khó khăn không phải là điều kiện để được miễn biệt phái. Vì vậy, trong trường hợp này, bạn nên liên hệ trình bày hoàn cảnh với lãnh đạo cơ quan để được xem xét, giúp đỡ.
