Tôi vá»­a  nhập cảnh vào Mỹ (14/10/2012) theo diện ma mẹ bảo lãnh con trên 21 tuổi chÆ°a có gia đình. Hiện tại tôi đã được cấp thẻ xanh có thời hạn 10 năm. Vào ngày 9/12/2012 (thời gian ở Mỹ là 55 ngày) tôi có trở về Việt Nam đăng ký kết hôn vá»›i vợ tôi tại Việt Nam, do gặp vấn đề về thủ tục đăng ký nên ngày 2/2/2013 tôi má»›i trở về Mỹ. Tôi có nghe nói là nếu tôi ở lại Việt Nam lâu hÆ¡n thời gian ở Mỹ (hÆ¡n 55 ngày) hay 60 ngày thì tôi sẽ gặp khó khăn khi nhập cảnh lại Mỹ (có thể bị hủy thẻ xanh đã cấp hiện tại). Cho tôi hỏi là Ä‘iều này có đúng không? Và tôi cần phải làm gì để có thể nhập cảnh vào Mỹ trở lại."

Tôi tư vấn trường hợp của bạn như sau:

Luật pháp Mỹ quy định đã là thường trú nhân (tức là đang sử dụng thẻ xanh ) không được rời khỏi nước Mỹ quá 12 tháng. Như vậy, việc bạn ở lại Việt Nam 60 ngày tức là không quá 12 tháng thì không gặp khó khăn gì cho việc quay lại nước Mỹ cả.

Nếu có những trường hợp ngoài ý muốn của chúng ta rời khỏi Mỹ quá 12 tháng như bệnh tật, tai nạn v.v....phải ở Việt Nam chữa trị hoặc ở một nước nào đó thì trước khi bạn dự định chuẩn bị rời khỏi Mỹ thì bạn phải nộp đơn xin RE-ENTRY PERMIT (cuốn sổ này tương tự giống hộ chiếu nhưng thời hạn tối đa chỉ là 2 năm) nhằm mục đích giúp bạn có thể rời khỏi Mỹ trong thời gian không quá 2 năm.
